Legal Remedies for Downing Flight MH17

On 17 July 2014, Malaysia Airlines Flight MH17 from Amsterdam to Kuala Lumpur was shot down over Eastern Ukraine. On board the Boeing 777 were 283 passengers and 15 crew members who all lost their lives. The victims’ families and the states whose nationals were lost now seek remedies from those that are responsible for this tragedy. This white paper addresses in detail possible legal redress mechanisms that may be available to victims and their states: 1) the International Court of Justice (ICJ); 2) the European Court of Human Rights (ECtHR); 3) the International Criminal Court (ICC); 4) prosecutions in domestic criminal courts; and 5) civil litigation proceedings.
